Overview
Welcome to Diamond Snapp. These Terms of Service ("Terms") govern your use of the Diamond Snapp website and services (the "Service") operated by Diamond Snapp LLC ("us", "we", or "our").
Diamond Snapp is an event photo sharing platform that allows event hosts to collect photos from guests through QR codes and create shared galleries. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use another person's account without permission. Creating an account with false information is prohibited.
User Content
Our Service allows you and your event guests to post, upload, and share content, including photos and messages ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, perform, display, reproduce, and distribute such content on and through the Service for the purpose of providing and improving our service. You retain any and all of your rights to any User Content you submit, post, or display on or through the Service.
You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
Guest Content
When guests upload photos to your event, they grant you and Diamond Snapp the necessary rights to display, store, and share these photos within your event gallery. You are responsible for ensuring guests understand and consent to having their photos included in your event gallery.
Content Moderation
We reserve the right to review and remove any User Content that violates these Terms or is otherwise inappropriate, illegal, or harmful. We are not obligated to monitor all User Content but may do so at our discretion.
Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:
- Use the Service in any manner that could disable, overburden, damage, or impair the Service
- Use any robot, spider, or other automatic device to access the Service without permission
- Introduce any viruses, trojan horses, worms, or other material which is malicious or technologically harmful
- Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
- Upload or transmit any material that infringes any intellectual property rights
- Upload or transmit any material that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Upload or transmit any material that depicts minors in suggestive or inappropriate contexts
- Impersonate or attempt to impersonate another user or person
- Collect or track the personal information of others without consent
- Interfere with or circumvent the security features of the Service
- Use the Service for any commercial purposes without our written consent
- Reverse engineer, decompile, or disassemble any part of the Service
Payment Terms
Diamond Snapp offers three packages for event photo sharing:
- Basic ($9.99): Up to 100 photos, 1 week storage, basic slideshow, public gallery sharing
- Premium ($49.00): Up to 500 photos, 1 month storage, photo filters, custom branding, advanced gallery features
- Ultimate ($99.00): Up to 1000 photos, 3 months storage, music slideshow, bulk download, all premium features
By selecting a package and providing payment information, you agree to pay the one-time fee associated with your chosen package. You may upgrade your package at any time during the storage period by paying the difference in price.
All payments are processed securely through Square, our PCI DSS compliant payment processor. We do not store full credit card details on our servers.
Refunds
Refunds are available within 48 hours of purchase if you have not yet used the service (i.e., no photos have been uploaded to your event). After photos have been uploaded or 48 hours have passed, all sales are final.
Storage Limits and Expiration
Photos uploaded to your event will be automatically deleted after the storage period expires unless you upgrade your package. We provide notifications before expiration, but we are not responsible for data loss due to expired storage periods. It is your responsibility to download photos before expiration.
Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Diamond Snapp LLC and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We respect the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us with details.
Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Diamond Snapp does not warrant that: (a) the Service will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
We do not guarantee the permanent storage of User Content and are not responsible for data loss due to technical failures, expired storage periods, or other circumstances beyond our control.
Limitation of Liability
In no event shall Diamond Snapp, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid for the Service.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. Your User Content may be deleted, and we cannot recover it after termination.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
